Accesseon provides automated accessibility testing results as informational guidance only. Our scans do not constitute legal compliance certification, legal advice, or a guarantee of ADA, WCAG, EAA, or any other regulatory compliance. Automated testing can identify approximately 30–40% of potential accessibility barriers. Full compliance requires comprehensive manual expert review. Accesseon is not liable for any legal claims, lawsuits, fines, penalties, or damages arising from reliance on scan results. We do not guarantee that fixing reported issues will make a website legally compliant.

1. Service Description & Limitations

These Terms of Service ("Terms") govern your use of Accesseon ("we," "our," "the Service"), a web accessibility scanning tool available at accesseon.com. By creating an account or using the Service, you agree to these Terms.

Accesseon is an automated web accessibility scanner. You provide a URL, and the Service:

  • Scans the page for WCAG 2.2 violations using the open-source axe-core testing engine
  • Calculates a score based on the number and severity of violations found
  • Generates a report with identified issues and AI-generated fix suggestions
  • Optionally exports the report as a PDF (paid plans only)

Important limitations:

  • Automated testing identifies approximately 30–40% of potential WCAG accessibility barriers. Many criteria — including reading order, cognitive clarity, screen reader user experience, and keyboard workflow — require human evaluation.
  • Results are informational only and do not constitute compliance certification under any law, regulation, or standard.
  • A comprehensive accessibility audit requires manual expert review by a qualified accessibility consultant.
  • We do not guarantee that fixing all reported issues will make your website legally compliant with the ADA, EAA, Section 508, AODA, or any other accessibility law.
  • Scan results reflect the state of the page at the time of scanning. Results may differ if the page content, structure, or styling changes.
  • Some rules may produce false positives (flagging issues that are not real barriers) or false negatives (missing real barriers). Rules flagged as "Verify manually" are particularly prone to false positives.

Accesseon is a software tool, not a law firm, legal consultancy, or compliance certification body. Nothing in the Service — including scores, grades, compliance labels, fix suggestions, or any other output — constitutes legal advice.

The terms "compliant," "non-compliant," "at risk," and similar language in reports refer to technical conformance with WCAG criteria as detected by automated testing — not legal compliance status under any law or regulation.

You should not rely on scan results as evidence of legal compliance. If you are concerned about ADA, EAA, Section 508, AODA, or any other accessibility law, consult a qualified attorney and engage a certified accessibility auditor for manual review.

Accesseon is not responsible for any legal claims, regulatory fines, penalties, lawsuits, demand letters, or damages arising from reliance on scan results — whether the results identified issues or reported a clean scan.

3. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Accesseon's total aggregate liability for any claim arising from or relating to the Service is limited to the amount you actually paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
  • In no event shall Accesseon be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: lost profits, lost revenue, lost data, business interruption, cost of substitute services, regulatory fines, legal fees, court costs, settlement amounts, or any third-party claims.
  • This limitation applies regardless of the cause of action — whether in contract, tort (including negligence), strict liability, warranty, or otherwise.
  • This limitation applies even if Accesseon was advised of the possibility of such damages or knew or should have known of the possibility.
  • Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

4. Warranty Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • Implied warranties of merchantability
  • Implied warranties of fitness for a particular purpose
  • Implied warranties of non-infringement
  • Any warranty that the Service will be uninterrupted, timely, secure, or error-free
  • Any warranty that scan results will be accurate, complete, current, or reliable
  • Any warranty that defects will be corrected

You use the Service at your own risk. You are solely responsible for determining the appropriateness of using the Service and assume all risks associated with its use.

5. Indemnification

You agree to indemnify, defend, and hold harmless Accesseon, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of or inability to use the Service
  • Your reliance on scan results for any purpose, including legal compliance
  • Any third-party claim that your website is not accessible or does not comply with applicable law
  • Any violation of these Terms by you
  • Your violation of any rights of any third party

6. Acceptable Use

You agree not to:

  • Scan websites you do not own or have explicit written authorization to test
  • Use automated tools, scripts, or bots to mass-scan websites beyond your plan limits
  • Circumvent rate limits, access controls, or other security measures
  • Use scan results to harass, threaten, or extort website owners
  • Submit URLs that point to malicious, illegal, or CSAM content
  • Use the Service to scrape, harvest, or collect data from third-party websites
  • Resell access to the Service without written authorization
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service

We reserve the right to suspend or terminate accounts that violate these terms without prior notice and without refund.

7. Accounts

You may use the Service without an account (limited free scans). To access the dashboard, scan history, and paid features, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 16 years old to create an account.

8. Payment & Refunds

Accesseon offers the following plans:

  • Free — 3 scans per month, no account required, no PDF export
  • Starter ($29/month) — 50 scans per month, PDF export, AI fix suggestions
  • Pro ($79/month) — Unlimited scans, all Starter features plus API access

All paid plans are billed monthly through LemonSqueezy, which acts as our Merchant of Record. LemonSqueezy handles payment processing, sales tax, VAT, and invoicing. By subscribing to a paid plan, you also agree to LemonSqueezy's terms of service.

Paid plans include a 14-day free trial. You will not be charged during the trial period. You may cancel at any time from your dashboard or through the LemonSqueezy customer portal.

  • If you cancel during the trial, you will not be charged.
  • If you cancel after the trial, paid features remain active until the end of the current billing period.
  • No partial refunds are provided for unused time within a billing period.
  • Prices are in USD and may change with 30 days' prior notice to existing subscribers.

9. Data Handling

We collect and process data as described in our Privacy Policy. Key points:

  • URLs you submit are scanned by our servers. The page's HTML is processed in memory and not stored after scan completion.
  • Scan results (scores, violations, fix suggestions) are stored in our database for 12 months and associated with your account.
  • Small HTML snippets from violations are sent to Anthropic's Claude API to generate fix suggestions. No personal data is sent.
  • Scan report pages are publicly accessible via their share link.
  • You may request deletion of your data at any time by emailing legal@accesseon.com.

10. Intellectual Property

The Accesseon software, branding, and website content are our property. Scan reports generated for you are yours — you may share, export, and use them freely. The accessibility scanning engine uses the open-source axe-core library (Mozilla Public License 2.0).

11. Governing Law & Dispute Resolution

For users in the United States:

  • These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
  • Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association, conducted in English.
  • You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
  • Claims must be brought within one (1) year of the event giving rise to the claim.

For users in the European Union / EEA:

  • Nothing in these Terms limits your rights under mandatory EU consumer protection law, including the Consumer Rights Directive (2011/83/EU).
  • You may bring claims in the courts of your country of residence.
  • You may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

For users in other jurisdictions:

  • These Terms are governed by the laws of the State of Delaware, USA, to the extent permitted by your local law.
  • If mandatory local laws provide greater protections, those protections apply.

12. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers by email at least 30 days before material changes take effect. Continued use of the Service after changes constitutes acceptance. If you do not agree with updated Terms, you must stop using the Service and may cancel your subscription.
